Please read these Terms carefully before using CircleWatch. If you do not agree with any part of these Terms, you must not use the platform. Continued use of CircleWatch constitutes your acceptance of the most current version of these Terms.
A
Eligibility
Who may use CircleWatch

To access and use CircleWatch you must satisfy all of the following eligibility requirements at all times. Failure to meet these requirements may result in immediate account termination.

Minimum Age (COPPA). You must be at least 13 years of age. CircleWatch does not knowingly collect or process personal data from individuals under 13. Accounts found to belong to under-13 users will be terminated without notice and reported to the appropriate authorities where required by law.
Minors (13–17). If you are between 13 and 17 years of age, you must have the knowledge and permission of a parent or legal guardian to use CircleWatch. Participation in monetization programs requires documented guardian authorization.
Geographic Availability. You must reside in a region where CircleWatch is legally permitted to operate. Access from jurisdictions where the platform is prohibited or restricted is not authorized under these Terms.
Legal Capacity. You must have the legal capacity to enter into a binding agreement. If you are accessing CircleWatch on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
B
Account Responsibilities
Your obligations as an account holder

You are solely responsible for your account and all activity that occurs under it. CircleWatch is not liable for losses arising from unauthorized account access that result from your failure to follow these obligations.

Account Security. You are responsible for maintaining the confidentiality of your credentials, including your password. You must use a strong, unique password and must not share your login information with any third party.
Unauthorized Access. You must notify CircleWatch immediately upon becoming aware of any unauthorized access to your account, any suspected breach of security, or any use of your account that violates these Terms.
Non-Transferability. Your account is personal and non-transferable. You may not sell, trade, lease, gift, or otherwise transfer your account or any associated rights to any other person or entity.
Accurate Registration. You must provide accurate and complete information when creating your account and must keep this information up to date. Providing false information is grounds for immediate termination.
C
User Content
Ownership, license, and restrictions

By uploading, submitting, or publishing any content to CircleWatch — including videos, posts, comments, thumbnails, or group materials — you agree to the following license grant and content restrictions.

License Grant to CircleWatch

You grant CircleWatch a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, distribute, and modify (for technical purposes only, such as compression, format conversion, and CDN delivery) your content for the duration of your account. This license exists solely to operate and improve the platform and does not transfer ownership.

You retain full ownership of all content you upload. CircleWatch does not claim ownership over your creative work.
Representation. By uploading content, you represent and warrant that you own all necessary rights, or have obtained all required permissions and licenses, to grant CircleWatch the rights described above.

Prohibited Content

Copyrighted material for which you do not hold rights or a valid license
Illegal content of any kind, including CSAM — which results in immediate permanent termination and law enforcement referral
Harmful or malicious files, scripts, or executable code
Any content that violates the CircleWatch Community Guidelines (Section F)
D
Monetization
Creator payment programs and obligations

Creators who enroll in any CircleWatch monetization program — including Popcoins, ad revenue sharing, or channel memberships — agree to the following terms in addition to the separate Monetization Agreement.

Monetization Agreement. Participation requires acceptance of the full Monetization Agreement, which governs eligibility thresholds, payout schedules, and program-specific rules.
Tax Compliance. You are solely responsible for reporting and remitting all applicable taxes on income earned through CircleWatch. CircleWatch will provide required tax documentation (e.g., 1099-NEC) where legally required.
No Fraudulent Activity. Any attempt to artificially inflate earnings through bots, click fraud, coordinated manipulation, or any deceptive means will result in immediate monetization removal, forfeiture of outstanding balances, and potential account termination.
Payout Thresholds. Payouts are subject to minimum thresholds and processing times as specified in the Monetization Agreement. CircleWatch is not liable for delays caused by third-party payment processors.
Program Changes. CircleWatch reserves the right to modify, suspend, or terminate monetization programs at any time. Continued participation after notification of changes constitutes acceptance.
⚠️
Important: Monetization enrollment requires users to be at least 18 years of age, or to have documented parental/guardian authorization if between 13 and 17. Misrepresentation of age during enrollment is grounds for immediate termination and forfeiture of earnings.
E
Advertising
How ads operate on the platform

CircleWatch operates an advertising system that allows display and video ads to be shown across the platform. By using CircleWatch, you acknowledge and consent to the placement of advertisements.

Ad Placement. Advertisements may appear on videos, profile pages, group pages, and within creator content. Placement is determined algorithmically based on content category, user context, and advertiser targeting.
Creator Ad Revenue. Eligible creators may participate in ad revenue sharing programs as described in the Monetization Agreement. Participation is subject to eligibility criteria and CircleWatch's sole discretion.
Advertiser Standards. All advertisers on CircleWatch must comply with our Advertising Policies. CircleWatch does not endorse the products or services advertised on the platform.
No Ad Interference. You may not use ad-blocking circumvention techniques, fraudulent ad interactions, or any mechanism designed to manipulate or defraud the advertising system.
F
Community Guidelines
Incorporated by reference

The CircleWatch Community Guidelines are hereby incorporated into and made a part of these Terms of Service by reference. Compliance with the Community Guidelines is a condition of your continued use of the platform.

The Community Guidelines govern permitted and prohibited conduct, content standards, group rules, and behavioral expectations for all users.
CircleWatch reserves the right to update the Community Guidelines at any time. Updates take effect upon posting and continued use of the platform constitutes acceptance.

Violations of the Community Guidelines may result in any of the following enforcement actions, applied at CircleWatch's sole discretion:

Content Removal
Feature Restriction
Monetization Suspension
Temporary Account Suspension
Permanent Termination
G
DMCA Policy
Digital Millennium Copyright Act compliance

CircleWatch complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) and responds to properly submitted notices of copyright infringement. The procedures below govern how to submit and respond to such notices.

1
Your full legal name and the capacity in which you are submitting (owner or authorized agent)
2
Your contact information, including mailing address, telephone number, and email address
3
A description of the copyrighted work you claim has been infringed, including any applicable registration numbers
4
Identification of the infringing content on CircleWatch, with sufficient detail for us to locate it (e.g., URL or content ID)
5
A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law

Send DMCA Notices To
dmca@circlewatch.com
Notices that do not comply with 17 U.S.C. § 512(c)(3) will not be processed. Submitting a false takedown notice may result in liability for damages under 17 U.S.C. § 512(f).
SUBMITTING A COUNTER-NOTICE

If your content was removed pursuant to a DMCA takedown notice and you believe the removal was made in error or that the content was not infringing, you may submit a counter-notice containing all of the following:

1
Your full legal name and contact information
2
Identification of the removed or disabled content and the location at which it appeared before removal
3
A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification
4
Your consent to the jurisdiction of the U.S. federal district court for the district in which your address is located (or any U.S. district if outside the U.S.) and your agreement to accept service of process from the party who submitted the original takedown notice
5
Your physical or electronic signature

Upon receipt of a valid counter-notice, CircleWatch will forward it to the original complainant and may restore the removed content after 10–14 business days, unless the copyright owner files legal action against you during that period.

Note on Minors and DMCA

The DMCA does not impose a minimum age requirement for filing notices or counter-notices. However, because minors generally lack the legal capacity to enter binding contracts, CircleWatch may require the involvement of a parent or legal guardian for any DMCA dispute involving a user under 18 years of age.

ℹ️
Repeat Infringer Policy. In accordance with 17 U.S.C. § 512(i), CircleWatch will terminate the accounts of users who are determined, in CircleWatch's reasonable discretion, to be repeat copyright infringers.
H
Termination
Grounds for account suspension or termination

CircleWatch reserves the right to suspend or permanently terminate any account, with or without prior notice, for any of the following reasons. Termination does not entitle you to any refund of Popcoins, subscription fees, or outstanding monetization balances except where required by applicable law.

Violation of the Community Guidelines or any provision of these Terms
Engaging in illegal activity through or in connection with the platform
Repeated or egregious copyright infringement under the Repeat Infringer Policy
Fraudulent monetization activity, including click fraud, engagement manipulation, or falsification of eligibility information
Actions that constitute a security threat to CircleWatch, its infrastructure, or its users
Non-payment of applicable fees, if any, or chargebacks made in bad faith

Voluntary Termination. Users may terminate their account at any time by following the account deletion process in Settings. Upon deletion, your public content may be removed at CircleWatch's discretion, subject to any legal retention obligations.

⛔
Certain violations — including CSAM, platform hacking, and law enforcement referrals — result in immediate permanent termination with no warning, no appeal, and no recourse.
